Terms of Service

These Terms of Service ("Terms") govern access to and use of Afterdark (the "Service"), operated by Afterdark ("Afterdark," "we," "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Service. By using the Service you represent and warrant that you meet this requirement. We may require age verification before granting access in certain jurisdictions.

2. Nature of the content

All characters, images, video and chat personas generated through the Service are entirely synthetic and computer-generated. The Service does not accept uploads of photographs of real people for generation purposes and does not knowingly generate content depicting an actual, identifiable individual. See our 2257 Compliance Statement.

3. Acceptable use

Use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of that policy is grounds for immediate suspension or termination, and, where legally required, referral to law enforcement.

4. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@afterdark.ac of any unauthorized use.

5. Content ownership and license

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a personal, non-exclusive, non-transferable license to use and privately store content you generate through the Service. We do not claim ownership of your generated content, but you grant us a limited license to store, process, and (where necessary for moderation, legal compliance, or fraud prevention) review it.

6. Subscriptions and billing

Paid plans, where offered, renew automatically until cancelled. Pricing, billing cycles, and cancellation mechanics will be presented at checkout and are incorporated into these Terms. Payments are processed by a third-party payment processor; we do not store full payment card details.

7. Moderation and enforcement

We use automated systems and human review to screen generated content for policy violations, including content that may depict a minor or a real, identifiable person. We may remove content, suspend, or terminate accounts that violate these Terms or the Acceptable Use Policy, and may report unlawful content (including suspected CSAM) to the National Center for Missing & Exploited Children (NCMEC) or other authorities as required by law.

8. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, the Acceptable Use Policy, or applicable law. You may stop using the Service and close your account at any time.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Afterdark will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Governing law

Governing law and dispute-resolution mechanism (including any arbitration clause) to be finalized with counsel and inserted here before this page is treated as binding.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date.
